Through using this website, you agree to the following terms and conditions. If you do not agree to the terms and conditions of this website, we kindly ask you to please refrain from using this website.
The Kite Bus reserve the right to change, modify or revise these website terms and conditions at any time without notice. Please check periodically for changes as your continued use of this website will constitute your acceptance of the changes made.
Sale conditions
The Kite Bus will in no event be held accountable or liable for death, injuries to people or property or for incidental, contingent and or consequential damages that may arise from the use of our products.
Kitesurfing may be dangerous. Please exercise caution and use appropriate safety equipment such as helmets.
If you are not competent in the use of the product ordered, please seek professional instruction for your safety and the safety of others. Contact Us we are only too happy to help.
Gift certificates
Gift certificates are valid for twelve months from the date of purchase.
Gift certificates are transferable between all courses and may be given to a third party. Unfortunately, gift certificates are not redeemable under any circumstance. It is the responsibility of the recipient to contact the Kite Bus to make a booking to complete the certificate within the twelve-month period. Lost or stolen certificates may be redeemed if subject to proof of purchase. The Kite Bus reserves the right to refused replacement of lost certificates.
Rental equipment
Proof of prior lessons is preferred however not essential. A safety assessment is conducted to determine if the hirer has sufficient ability for rental or requires supervision. If deemed not suitable for rental equipment The Kite Bus will book a lesson for you at the next available time.
The hirer is responsible for returning rental equipment on time and with no damage. In the event that the rental equipment is returned late, an extra charge may be incurred. Please inspect your rental equipment for damage prior to taking it from The Kite Bus. It is a requirement of The Kite Bus that identification documents are copied, and the details of a valid credit card are supplied. We will inspect equipment for damage upon its return and if damage has occurred the repair costs will be charged to the credit card supplied. If a repair is not possible or the equipment is lost or stolen, the hirer will be charged the replacement cost of the equipment.
Instructor supervision is not a lesson. If at any time a member of The Kite Bus intervenes or renders assistance or is required to handle the equipment during supervision or rental, the supervision or rental will be viewed as a lesson and the hirer will be charged at the current lesson price.
The Kite Bus provides a safety overview before equipment rental. The Kite Bus reserves the right to immediately cancel equipment rental at any time when the hirer is deemed to be using equipment in an unsafe manner or inappropriately or where members of the public may be at risk.
Lessons and cancellations
Lessons are to be paid in full at the time of booking.
Lessons are not refundable. However, lessons are transferable to another person. Lessons are to be completed within twelve months from the date of payment. Any unused lesson time not completed in the specified time will be forfeited.
If you are unable to attend a lesson or tour you must inform The Kite Bus and cancel or reschedule before 4.00pm the day prior to avoid any cancellation fees or deductions. If you fail to provide notice or do not turn up for a lesson booking or tour, the time will be deducted from your lesson or tour. If you do not turn up on time for your lesson booking or tour, the amount of time you are late will be deducted from the overall lesson time. Special circumstances may be considered if appropriate documentations are able to be provided.
We advise you to begin your lessons as soon as possible. If you are only in the Batemans Bay area for a short period of time, please understand that it may take some weeks for completion as lessons are weather dependent.
If the weather conditions are not suitable or unexpectedly change and we need to cancel your lesson, we will do our very best to provide as much notice as possible. If your lesson has been cancelled The Kite Bus will reschedule your lesson to the next available time. In circumstances where the weather may change unexpectedly during your lesson, it may be cancelled or shortened by The Kite Bus. If this happens then the remaining time will be rescheduled to the next time spot available.
Refunds and returns
For customer satisfaction and peace of mind The Kite Bus may accept exchanges or refunds of products purchased from our website. It is at the expense of the buyer to return or exchange products, if products are to be returned they must be in new condition and within fourteen days of purchase.

Unauthorised or commercial use of multimedia material or content displayed on The Kite Bus website is strictly prohibited. If you would like to use or link to our website, please Contact Us to ask permission. We do our very best to ensure the information available is accurate, however we are unable to guarantee this and thus The Kite Bus assumes no legal liability or responsibility for the information.
Warranties
Warranties and claims offered are that of the manufacturers and not that of The Kite Bus.
The manufacturers warranties offered do not apply to damage due directly or indirectly to misuse, abuse, negligence or accidents, alterations, normal wear and tear or lack of maintenance. Please refer to the manufacturer’s documentation for more information. The Kite Bus hereby disclaims and negates all other warranties or merchantability conditions.

The Kite Bus may not have reviewed all of the website links on its website and is not responsible for the content of any linked website. The inclusion of a linked website does not imply endorsement by The Kite Bus. If you choose to use any linked website, it is at your own discretion.
Pricing
All prices on our website are in Australian dollars (AUD) and are inclusive of GST.
In the event that a product has been mistakenly listed or inadvertently listed for an incorrect price, The Kite Bus reserves the right to cancel or refuse any orders placed. If an order has been cancelled by The Kite Bus, then the received amount will be refunded. Prices on our website may change without notice.
Payment must be made before lessons, tours or equipment rentals commence. If payment is not received, then The Kite Bus reserves the right to treat the booking as cancelled.
Shipping
Postage times and costs are quoted by freight service companies and are estimates only. Delivery is normally between 3 – 7 working days and should not exceed 60 days. The Kite Bus cannot be held responsible for late deliveries, loss or damage as we rely on a third party. The Kite Bus will not be held responsible for incorrect or incomplete delivery details where supplied by the customer. Information and details are held until the order has been completed. If goods have major faults/defects then full refunds inclusive of postage are available as per Australian Consumer Law.
